Litigation is time consuming and expensive, so it is always advisable to negotiate a settlement of legal disputes whenever possible. Unfortunately, some disputes cannot be settled either because the parties are unable to reach an agreement or as a consequence of the specific relief sought (e.g. attachment, eviction, injunction, etc.). Under such circumstances it is necessary to seek relief in the Courts, and litigants need an experienced advocate to protect their interests. Mr. Stein has extensive litigation experience in several areas, including: breach of contract, breach of fiduciary duty, breach of warranty, conversion, fraud/misrepresentation, misappropriation, negligence and unjust enrichment, as well as Tennessee statutory claims under the Consumer Protection Act and the Uniform Residential Landlord Tenant Act. He has worked on cases ranging from small claims to multimillion dollar lawsuits, and will fight to ensure his client’s rights are well protected regardless of whether they appear before the Court as a plaintiff or defendant.
Domestic Relations involves numerous family law related matters including separation, divorce, alimony, child custody, visitation and support. These issues often touch upon some of the most emotionally and financially critical aspects of our lives, so skilled counsel is indispensable in such cases. Mr. Stein drafts equitable Prenuptial and Separation Agreements, represents clients in both contested and uncontested divorces, as well as petitions the Courts to modify child custody/visitation orders. He will vigorously fight to ensure clients retain ownership of their separate property and receive a fair division of all marital property during contested divorces. Mr. Stein also practices Collaborartive Law as a means of resolving divorces in an equitable and serene manner. Finally, Mr. Stein works in the Juvenile Courts handling paternity matters including establishing or refuting parentage, and setting or modifying child support/visitation.
